1. Agreement

These Terms of Service constitute a legally binding agreement between you and topmind GmbH (Ziehrerstraße 24, 9020 Klagenfurt, Austria), operating under the brand "Colorburst". By creating an account or using our service, you agree to these Terms and our Privacy Policy .

You must be at least 14 years old to use Colorburst (the minimum age under Austrian data protection law). If you are under 14, you need parental consent.

2. The Service

Colorburst is an AI-powered platform for generating printable coloring book templates. Our infrastructure is hosted entirely in the EU (Hetzner, Germany). We use third-party AI providers for image generation, which may include EU-based providers (e.g., Mistral) or international providers with EU data processing agreements. We use Sentry, PostHog, and Langfuse (all EU-hosted) for analytics and monitoring.

We may modify or discontinue features at any time. We aim to notify you of significant changes but do not guarantee uninterrupted service.

3. Your Account

When you create an account, you agree to:

• Provide accurate information
• Keep your password secure
• Accept responsibility for all activity under your account
• Notify us of any unauthorized access

4. Acceptable Use

You may use Colorburst to generate coloring templates for personal or commercial use. You agree not to:

• Create illegal, harmful, hateful, or sexually explicit content
• Infringe intellectual property rights
• Attempt to circumvent security measures or reverse engineer the service
• Use automated tools without permission

5. Content & Intellectual Property

Your prompts: You retain ownership of the prompts and descriptions you submit. You grant us a license to use them to provide and improve the service.

AI-generated templates: Under current EU law, purely AI-generated content may not qualify for copyright protection as it lacks human authorship. You are free to use, download, print, modify, and distribute templates generated through Colorburst for personal or commercial purposes. We do not claim ownership of AI-generated outputs and will not restrict your use of them.

We make no guarantees about uniqueness or exclusivity—similar prompts may produce similar results for other users. You are responsible for ensuring your use complies with applicable laws.

Our platform: The Colorburst software, design, and branding remain our property.

6. Feedback & Suggestions

If you share feedback, ideas, or suggestions about Colorburst, you grant us the right to use them freely without restriction or compensation. We are not obligated to keep feedback confidential or to implement any suggestions.

7. Fees

Colorburst is currently free to use with usage limits. We may introduce paid features in the future. If we do, we will notify you in advance and clearly display pricing before any purchase.

8. Limitation of Liability

To the extent permitted by Austrian law, topmind GmbH is not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding any claim.

These limitations do not apply to: (a) liability for intent or gross negligence; (b) death or personal injury caused by our negligence; (c) fraud or fraudulent misrepresentation; or (d) any other liability that cannot be excluded under applicable law.

This does not affect your statutory rights as a consumer under EU or Austrian law.

9. Termination

You may delete your account at any time from your account settings. Upon deletion, your personal data will be removed in accordance with GDPR Article 17 (Right to Erasure), except where we are required by law to retain certain data (e.g., for tax, accounting, or fraud prevention purposes). See our Privacy Policy for retention periods.

We may suspend or terminate accounts that violate these Terms or for legal reasons.

10. Privacy & Data Protection

We process your personal data as described in our Privacy Policy . The legal bases for processing include contract performance (GDPR Article 6.1.b) for core service functionality, and legitimate interest (Article 6.1.f) for analytics and service improvement. You have rights under GDPR including access, rectification, erasure, and data portability.

11. Governing Law

These Terms are governed by Austrian law. Disputes are subject to the jurisdiction of the courts in Klagenfurt, Austria. If you are a consumer in the EU, this does not affect your right to bring proceedings in your country of residence.

12. Changes

We may update these Terms. For material changes, we will notify you via email at least 30 days before they take effect. If you do not agree to the new terms, you may terminate your account before they take effect. Continued use after changes take effect constitutes acceptance.
